In February of 2016 Yukon’s Member of Parliament, the Honourable Larry Bagnell introduced a Private Member’s Bill, Bill C-235, to amend the Criminal Code and the Corrections and Conditional Release Act with respect to fetal alcohol disorder.

The enactment of Bill C-235 would:

  • amend the Criminal Code to establish a procedure for the assessment of individuals who may suffer from fetal alcohol disorder and are involved in the criminal justice system. 
  • require the court to consider a determination that the offender suffers from fetal alcohol disorder as a mitigating factor in sentencing.
  • require the court to make orders to for individuals who are determined to suffer from a fetal alcohol disorder to follow an external support plan to ensure that they receive the necessary support to facilitate their successful reintegration into society.
  • require Correctional Service Canada to recognize the existence of fetal alcohol disorder as a disability within the correctional system.
